Question for lawyers

Postby pcqgod » 01 Aug 2017, 16:35

What do you call a response to a reply to a response to a motion? I've seen the term "sub-reply" used. is this the correct order?

Motion
Response to Motion
Reply to Response to Motion
Sub-Reply to Reply?

Or is a sub-reply an additional reply filed by the original movant?

I don't think there's an answer to that, unless it's dictated by a rule of state or federal civil procedure (and I doubt there's an applicable Texas rule). I think I've seen surreply, surrejoinder, or surrebuttal, but that's old school common law stuff and I think it sounds silly and isn't helpful. I might do it by date and party. "Defendants reply/response to plaintiff's July 15 reply" or some such.

Yes, "Sur-reply" was what I was thinking of. I think I'll just go with that. Thanks!

We use "Sur-Reply" in federal courts.

Now they'll have to caption it "Sur-Sur-Reply to Sur-Reply to Reply to Response to Motion to Strike," lol.

If you've got nothing to do, don't do it here.
